Now that marijuana is legal in more states, you might think that drug tests are no big deal. However, there are still many conflicting opinions on how to approach marijuana usage in the workplace.
Currently, over half of the population of the United States lives in a state with legalized recreational marijuana. Close to 11% of employed US adults report using cannabis. In states that have legalized marijuana, nearly half of users report using marijuana at or before work.
In the pre-hire process, 48% of employers do not test for marijuana. In fact, in some cities and states, it is illegal to conduct pre-employment drug tests. Another factor that further complicates these drug tests is the rate of invalid samples. Compared to 2022, invalid tests were up 45% in 2023. When a test is marked as invalid, it may indicate that someone mixed a sample with an additive.
Marijuana laws at work vary by state, and remain complex. As these laws continue to change, it is important to stay up-to-date.
